Site Terms
Terms current as of October 8, 2026
Acceptance
These terms explain the rules for using this website.
These Site Terms apply to your use of the Moments in the Wilderness website operated by Kasey Whitney Ministries LLC. They are available through the Site footer. By using the Site, you agree to comply with these Site Terms. If you do not agree, please do not use the Site. We may revise these Site Terms as described under Changes below.
Definitions
These are the terms used throughout this document.
“Site” means the publicly available pages and content at momentsinthewilderness.com and any subdomain operated by Kasey Whitney Ministries LLC that expressly links to these Site Terms. “Company,” “we,” “us,” and “our” mean Kasey Whitney Ministries LLC, a Georgia limited liability company. “You” means a visitor or user of the Site.
Disclosures
This section explains who operates the Site and the nature of the information it provides.
Company Identification: The Site is operated by Kasey Whitney Ministries LLC. It presents information about Dr. Kasey Whitney’s Moments in the Wilderness journal and related products or offerings.
Product Information: Descriptions, availability, and promotional information may change. We seek to keep information accurate, but we do not guarantee that every description is complete, current, or suitable for every visitor. Any purchase is subject to the terms presented by the seller at the time of purchase.
Visitor Content and Submissions
This section distinguishes content that we expressly invite you to submit from material that you send to us without an invitation. It also explains our publication rights, the rights you give us, and how we may handle submissions and related information.
Solicited Content: Solicited Content means a comment, review, testimonial, photograph, video, or other material that the Company expressly invites you to submit through the Site or through a communication channel that the Company designates for that purpose. Unless we expressly state otherwise when requesting the material, this section applies to Solicited Content.
When you submit Solicited Content, you represent and warrant that you own or control all rights needed to submit it and to grant the rights in this section; that the content is accurate to the best of your knowledge; and that neither the content nor the Company’s permitted use of it will infringe, misappropriate, or otherwise violate another person’s rights or applicable law.
Publication, Moderation, and License for Solicited Content: We may, but are not required to, review, publish, reproduce, display, distribute, edit, format, shorten, remove, or decline to publish Solicited Content. We may take those actions to operate and protect the Site, present content clearly, comply with these Site Terms or applicable law, or respond to concerns about accuracy, legality, safety, or the rights of others. We are not required to publish every submission, and publication does not mean that we endorse the content or its author.
You retain ownership of the Solicited Content that you own. However, by submitting it, you grant the Company a nonexclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, display, distribute, publish, edit for length, clarity, grammar, formatting, or technical compatibility, and otherwise use that Solicited Content in connection with operating, protecting, and promoting the Site and the Company’s related offerings. This license continues for as long as the Solicited Content remains available through the Site or is reasonably needed for the Company’s records, archives, backups, or the uses described in this paragraph. This license does not transfer ownership of your Solicited Content to the Company.
Unsolicited Submissions: Unless the Company has expressly requested or agreed in writing to receive a particular submission, the Company does not accept unsolicited ideas, suggestions, proposals, concepts, designs, product or service ideas, marketing ideas, content, or other materials relating to the Company or its products, services, development, design, marketing, business, or operations (collectively, “Unsolicited Submissions”). Unsolicited Submissions include materials sent, uploaded, posted, or otherwise delivered through the Site, contact forms, email, social-media channels, postal mail, or any other communication channel.
If you nevertheless submit an Unsolicited Submission, you agree that it is submitted voluntarily, is non-confidential, and creates no obligation for the Company to review, retain, return, safeguard, attribute, use, or compensate you for it. You represent and warrant that you own or control all rights necessary to submit the Unsolicited Submission and to make the assignment and grant the license in this section, and that neither your submission nor the Company’s exercise of the rights granted below will infringe, misappropriate, or otherwise violate any third party’s rights or applicable law.
To the maximum extent permitted by applicable law, you hereby irrevocably assign to the Company all worldwide right, title, and interest that you own or control in and to the Unsolicited Submission, including all copyrights and other transferable intellectual-property and ownership rights. If any assignment is ineffective, invalid, or prohibited as to any right, you instead grant the Company a perpetual, irrevocable, worldwide, fully paid-up, royalty-free, transferable, sublicensable, nonexclusive license to use, reproduce, modify, adapt, translate, create derivative works from, publish, display, perform, distribute, disclose, incorporate, and otherwise use that Unsolicited Submission, in whole or in part, for any lawful purpose, without further notice, consent, attribution, or compensation. To the maximum extent permitted by applicable law, you waive and agree not to assert any moral rights or similar rights that would restrict the Company’s exercise of these rights.
You will defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, and agents from and against claims, damages, liabilities, losses, and reasonable expenses, including reasonable attorneys’ fees, arising out of your breach of the representations or warranties in this section or a claim that an Unsolicited Submission infringes, misappropriates, or otherwise violates a third party’s rights.
Legal Requests and Privacy: We may preserve, use, and disclose Solicited Content, Unsolicited Submissions, and related identifying information when required by law or lawful legal process, as otherwise permitted by applicable law, to enforce these Site Terms, or to protect the rights, property, safety, or security of the Company, Site visitors, or others. Content published through the Site may be publicly visible. Personal information included in a submission will be handled in accordance with the Company’s Privacy Policy.
Prohibited Uses
This section explains ways you may not use the Site or our communication channels.
Permitted Use: You may browse the Site, learn about its offerings, and share ordinary links to it. You may not copy or commercially exploit Site content without the rights holder’s permission.
Electronic Mail and Communications: You may not use our email addresses, contact forms, or other communication channels to send material that is unlawful, obscene, profane, threatening, defamatory, invasive of privacy, or infringing upon intellectual property rights; or that contains harmful code, political campaign solicitations, unauthorized commercial solicitations, chain letters, unsolicited mass communications, or other material that violates applicable law.
Access: You may not use the Site in any manner that could damage, disable, overburden, or interfere with its operation. You may not bypass security measures, seek unauthorized access to restricted material, or systematically retrieve content without permission. Routine indexing by public search engines is not prohibited by this paragraph.
False Information: You may not knowingly provide false or misleading information through the Site’s forms or other interactive features.
Framing: You may not frame or embed Site content in a way that conceals its source or falsely implies our approval.
Links: You may link to public pages of the Site, provided the link does not falsely suggest an affiliation, endorsement, sponsorship, or approval.
Endorsements: You may not use the Company’s name, the Moments in the Wilderness name, or any logos or trademarks on the Site to imply affiliation, endorsement, sponsorship, or approval without permission.
Third Party Websites, Sellers, and Services
This section explains how links, references, and transactions involving third parties are handled.
The Site may contain links to, references to, or opportunities to interact with third-party websites, retailers, sellers, platforms, social-media services, payment providers, or other services (collectively, “Third-Party Services”). We provide these links or references for convenience and to help visitors locate related information, products, or services. Unless we expressly state otherwise, a link, reference, integration, or appearance of a Third-Party Service on the Site does not mean that the Company operates, controls, sponsors, endorses, recommends, approves, or guarantees that Third-Party Service, its content, its products or services, or its practices.
Third-Party Services are responsible for their own content, availability, accessibility, security, privacy practices, data-processing practices and locations, products, prices, promotions, order acceptance, payment processing, fulfillment, shipping, returns, customer service, and compliance with applicable law. To the fullest extent permitted by applicable law, the Company is not responsible for the acts, omissions, information, offerings, availability, privacy practices, security practices, or other conduct of any Third-Party Service. Your use of a Third-Party Service, and any transaction you enter into with it, is between you and that third party and is governed by its own terms, policies, notices, and procedures.
Before providing information to a Third-Party Service or making a purchase or other transaction, you should review its applicable terms of use or sale, privacy policy, security practices, shipping, return, refund, and customer-service policies, and any other terms that apply to your transaction. Third-Party Services may collect, use, store, disclose, or process your information under their own policies, which may differ from the Company’s Privacy Policy. The Company’s Privacy Policy applies to information handled by the Company, not to information handled by a Third-Party Service except as expressly stated in that policy.
Intellectual Property
This section explains ownership of Site content, trademarks, and how to report copyright concerns.
Copyright and Site Content: The Site’s text, design, graphics, images, and other content are owned by or licensed to Kasey Whitney Ministries LLC or their respective rights holders, unless otherwise indicated. You may view the Site and make reasonable copies for personal reference. You may not reproduce, republish, distribute, or commercially exploit protected content without permission.
Trademarks: Names, logos, and marks appearing on the Site belong to their respective owners. Their appearance does not grant permission for you to use them.
Copyright Notices: If you believe material available through the Site infringes a copyright that you own or are authorized to enforce, send a written notice to the Company using the copyright contact information posted on the Site. To allow us to evaluate the notice, include:
- Your physical or electronic signature.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, along with information reasonably sufficient for us to locate it on the Site.
- Information reasonably sufficient for us to contact you, including your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.
We may request additional information and may remove or disable access to the material, or take other appropriate action, while we review a notice. A person who knowingly materially misrepresents that material or activity is infringing may be liable for resulting damages, costs, and attorneys’ fees under applicable law.
Disclaimer of Warranties and Limitation of Liability
This section explains the limits of our responsibility for operation of the Site.
The Site and its information are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Kasey Whitney Ministries LLC disclaims warranties regarding uninterrupted availability, error-free operation, and fitness of the Site for a particular purpose, and is not liable for indirect, incidental, special, or consequential damages arising from use of or inability to use the Site. Nothing in these Site Terms limits rights or remedies that cannot lawfully be limited or waived.
Miscellaneous
This section addresses the law governing these Site Terms, changes, and other interpretive provisions.
Governing Law: These Site Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles, except where mandatory applicable law requires otherwise.
Jurisdiction and Venue: Except where applicable law requires a different forum, the state and federal courts located in Fulton County, Georgia, have exclusive jurisdiction over any dispute arising out of or relating to these Site Terms or your use of the Site. You and the Company consent to the personal jurisdiction and venue of those courts.
Mandatory Law and Severability. These Site Terms are intended to apply to the maximum extent permitted by applicable law. If any provision, or its application in a particular circumstance, is prohibited, invalid, or unenforceable, that provision will be limited only to the extent necessary, and the remaining provisions will remain in effect. Nothing in these Site Terms is intended to limit or waive any right or remedy that applicable law does not permit to be limited or waived.
Waivers: Our failure to enforce a provision on one occasion does not waive our right to enforce it later. A waiver must be made in writing by an authorized representative of Kasey Whitney Ministries LLC.
Section Headings: Headings and section summaries are provided for convenience and do not change the meaning of these Site Terms.
Changes: We may update these Site Terms by posting a revised version with a new effective date. Unless otherwise stated or required by law, changes apply to use of the Site after the updated terms are posted.
